Terms and Conditions for Holiday Renting

Thank you for choosing to book your holiday Accommodation through Mitchell’s Real Estate Pty Ltd..  We hope you have an enjoyable holiday and that your visit to the area will be as pleasant as possible.

Your holiday property is available to you from after 12.30pm on your day of arrival with vacate time 9am on your date of departure.  If you arrange to arrive outside normal business hours, accommodation must be paid for in full prior to arrival.  A deposit is required to secure your booking.  If your deposit is not received, your booking will be cancelled without notification. All bookings are from Saturday to Saturday (unless prior arranged).

Each holiday property is equipped for a specific number of holidaymakers.  Overcrowding will render the tenant liable to cancellation of the booking, and the agent reserves the right to terminate this agreement and request the property be immediately vacated without refund to the tenant.

During your stay noise must be kept to a reasonable level in particular between 10.00 p.m. and 8.00 a.m. Comply with parking regulations and show consideration to neighbours. Notify the agent of any complaints as soon as practicable. Be responsible for any guest. Maintain the security of the premises. Refrain from engaging in any drunken, obscene or antisocial behaviour. If the property is damaged during your occupancy due to accident, negligence or wilful act of the guest or the guests invitees the Premises will be repaired by us at the cost of the guest. Any damage over $500 or theft will be lodged with the Police.  Use of the property for any event other than a residential holiday is not allowed. Immediate termination of the booking will occur if any of the above is not adhered to.

Where applicable, the Body Corporate Rules and Regulations must be observed.  It is a breach of Body Corporate Rules to hang clothes or towels or other articles over balconies.  The property must not be used for any unlawful purpose.

We cannot accept responsibility for personal property such as cameras etc, that are left unattended in your holiday accommodation.  Neither the Body Corporate nor Mitchell’s Real Estate Pty. Ltd. are liable for any damage or loss of property which a person may sustain during their stay.

Special conditions apply for cancellations.  If you cancel your accommodation and we can secure a replacement booking for the same period, your deposit will be refunded less $35 administration fee.  If however the property cannot be relet, your deposit is not refundable.  If you shorten your stay, the unused portion of your rental is not refundable.

Re-bookings.  Must  be rebooked within the first week of your stay.  It is your responsibility to ensure that your deposit is paid within the designated time frame to secure your booking.

Breakages.  If you accidentally cause damage to your property either by way of keys, glass, furniture or furnishings, please report them to us as soon as possible.  Breakages or damages must be paid for.

DOGS OR OTHER PETS are not allowed in or about the premises.

When a booking is made, the deposit is accepted for the owner at that time.  If the property is for sale and the ownership changes before your holiday, we cannot guarantee that the property will remain available.  However, if the property does come on the market for sale, you will be notified immediately, allowing time to organise alternative accommodation.  If your rental property is listed for sale while you are in residence, no inspection will be made without prior notice and will be carried out only if absolutely necessary and always in the company of an employee of Mitchell’s Real Estate Pty Ltd..

In the case of refurbishment or owners instructions, rental rates may be subject to increase without notice.  Should this occur you will be notified immediately and given the opportunity to pay the difference in tariff or receive a full refund of your deposit.  We will also offer you alternate accommodation if possible.

We reserve the right for our representative or tradesmen to enter the property at any reasonable time to carry out repairs or maintenance work.

Duplicate keys are not always available.  Tenants are liable for damage caused when doors or windows have to be forced open owing to keys being lost or locked inside premises.  Tenants requiring a key from the agent or his representative after office hours will be charged a fee of $50, however, a representative may not be available after hours.

At times situations arise of which we have no control.  Mitchell’s Real Estate Pty Ltd reserves the right to move visitors to alternate accommodation of a similar standard at their discretion or the direct instruction of the landlord.  If this is the case, we will notify you as soon as possible and make every reasonable effort to make sure you are satisfied with your new rental.  The owner of the property reserves the right to cancel your booking at any time.  When booking your accommodation, our staff  have taken great care to describe your holiday accommodation to you as accurately as possible.  However, Mitchell’s Real Estate Pty Ltd cannot accept responsibility for incorrect descriptions, errors or omissions.
